Higher-Level Review

Same evidence, but a senior reviewer takes a fresh look.

Best for

  • There's a clear and unmistakable error (CUE) in the decision
  • The rater applied the wrong rating criteria
  • Favorable findings were ignored
  • Effective date was set wrong

Not for

  • You have new evidence — file a Supplemental Claim instead
  • You want to add new conditions

How it works

  1. 01File VA Form 20-0996 within 1 year.
  2. 02Optionally request an informal conference.
  3. 03A senior reviewer (DRO) re-examines the existing record.
  4. 04They issue a new decision — and can return the file for correction if errors are found.

Pro tips

  • Use the informal conference. It's your one chance to point the reviewer at the exact errors.
  • Be specific: cite the favorable finding, the CFR section, or the missed evidence by date.
  • If you discover new evidence mid-process, withdraw and refile as a Supplemental Claim.
